General Terms and Conditions
GIM - Genetic Institute Munich | Consumer orders
Text version: 12 October 2026
1 Seller and contracting party
Melinda Bartók, sole trader operating under the brand GIM - Genetic Institute Munich (GIM). Georg-Knorr-Straße 21, 85662 Hohenbrunn, Germany.
Email: info@geneticinstitute.eu.
VAT identification number: DE455817961.
These terms apply to consumer orders placed through GIM's online ordering interface. A consumer is an individual acting predominantly outside their trade, business or independent professional activity. GIM is the contracting seller and issues the customer invoice.
Novogenia GmbH, Strass 19, 5301 Eugendorf, Austria, assists with fulfilment as laboratory and product partner. GIM remains responsible to the customer for performance of the contract concluded with GIM. Involving a laboratory, manufacturer or carrier does not automatically transfer contractual customer claims to another business. In this ordering process GIM does not act solely as an intermediary.
2 Scope and contents of the order
We accept orders for delivery to Germany, Austria and Hungary. In this process, genetic analysis may only be ordered by an adult in their own name for testing their own sample. A partner enquiry alone creates neither a purchase nor a partnership contract. Partner commissions are governed by separate agreements.
The contract covers the product or package actually selected, with the contents, quantity and price displayed when ordering. The Analysis option includes the specified lifestyle DNA analysis, digital results report and sampling kit included in the price. The Set option also contains the personalised product specified in its description. Vitamins, creams and printed documents are included only if listed in the package or separately selected by the customer.
The names myGIM Blueprint and Masterplan refer to results documentation; they do not by themselves include a medical consultation or unlimited personal advice. Orders under these terms are one-off purchases without automatic renewal or subscription. Programmes shown on the website but not selected are not part of the contract.
Lifestyle analysis helps customers understand genetic traits related to lifestyle. It does not replace medical examination, diagnosis or treatment and does not guarantee a particular health outcome. Responsibility for the agreed performance remains unaffected. Medical genetic tests require the relevant professional and legal conditions to be met; general website statements do not replace them.
3 Ordering and contract formation
Product presentations invite customers to place orders. The customer selects a package and extras, enters details, receives the relevant information and makes the required declarations. Before submitting, the customer can check and correct details, products and the total price.
Activating the final order button, which clearly indicates an obligation to pay, submits a binding offer. The contract is formed when GIM sends an email accepting the order. A technical receipt or payment notification constitutes acceptance only if it expressly says so. If an order is not accepted, we refund payments already received without undue delay.
Contracts may be concluded in German, Hungarian or English. GIM emails the essential order details, applicable terms and withdrawal information in a form that can be saved. Contract data is stored in accordance with statutory retention duties. The Novogenia results account is not GIM's contract archive. Later website changes do not automatically amend existing contracts.
4 Prices payment and invoicing
Prices are in euros and include applicable VAT. The total for the package, extras and any other charges is displayed before ordering. A printed results report is optional; the current surcharge is EUR 40 including delivery within the EU. The price shown at the time of ordering applies.
Standard delivery to Germany, Austria and Hungary is free of charge. The prepaid label supplied is for sending the test sample to the laboratory; this is separate from returning goods following withdrawal.
Payment is processed through Stripe using the methods offered there. Accepted payment methods are indicated at the start of the ordering process. Payment is due during ordering; GIM issues the invoice. GIM does not store full payment card details. Chargeable extras require the customer's express selection.
5 Shipping and fulfilment
Novogenia arranges delivery of the ordered test kits, vitamins, creams and printed documents to the specified address, using carriers where necessary. Items may arrive in separate shipments; this alone does not incur additional delivery charges. Personalised products are manufactured after the analysis is completed and the necessary information is available.
In the current standard process, delivery of the sampling kit is expected within 4-5 working days after successful payment and confirmation. Analysis is expected to take 14-21 working days after the laboratory receives an analysable, identified sample and the required information and declarations. Manufacturing personalised vitamins or cosmetics is then expected to take another 4-5 working days, followed by delivery. Working days mean Monday to Friday, excluding public holidays at the relevant place of performance.
The specific delivery and performance deadline for the selected product, including delivery after manufacturing and delivery of a printed report, is provided before ordering and recorded in the confirmation. The time between receiving the kit and sending back the sample depends on the customer's cooperation.
After receipt, the test code can be linked to the order through the emailed link or the kit's QR code. The sample must be taken according to the instructions and sent to the specified laboratory address. GIM transfers the information required for performance through Novogenia's designated process.
We provide notice of foreseeable delays and the revised expected date. This alone does not change a contractual deadline or limit statutory rights relating to delay. For consumer deliveries arranged by GIM, GIM bears the risk of loss or damage until receipt by the customer or a designated third party who is not the carrier, subject to mandatory statutory exceptions.
6 Laboratory analysis and access to results
Novogenia GmbH performs the test. Novogenia provides protected personal access to results and a downloadable digital report. Status notifications follow the designated laboratory process. GIM's webshop database does not store raw genetic data or full results reports.
Using the digital report requires internet access, a reachable email address, a suitable browser and a PDF-capable device. The downloaded report may be retained for personal use. Portal access duration is determined by the information accompanying the order; lifetime access or automatic report updates are not promised without an express commitment. Mandatory rights concerning digital content and services, including applicable update obligations, remain unaffected.
Novogenia's general website terms do not automatically become part of the GIM purchase contract merely through a link. If a separate service requires its own contract, its provider, contents, price and terms will be disclosed before that contract is concluded.
7 Cooperation and defective or lost shipments
Customers must provide accurate information, submit their own sample and follow sampling, identification and return instructions. Material changes can be reported to info@geneticinstitute.eu. Samples from other people cannot be tested through this ordering process.
If a sample cannot be identified, is insufficient or cannot be analysed, we explain the next necessary step. Statutory conditions govern free replacement or repeat performance where the original performance was defective. If there is no entitlement to a free repeat, a separate charge requires advance price information and express customer agreement. We do not impose automatic repeat fees.
Lost, damaged or incorrectly supplied shipments should be reported to GIM. GIM coordinates the investigation. Enforcement of statutory customer rights does not depend on internal settlements between GIM, Novogenia and the carrier. Sending a sample and returning goods following withdrawal are separate procedures; biological samples must not be sent to GIM's postal address.
8 Written support and contact with doctors
The test price includes written answers to short questions about understanding results within the described scope. Depending on the question, the GIM team assists or involves the laboratory. This does not include a promised personal consultation with Melinda Bartók or unlimited individual advice.
WhatsApp is for ordering, organisational and technical questions; genetic reports, medical findings and detailed health information should not be sent through it. For medical questions, we provide information about available options and help establish contact on request. The customer chooses their doctor. A separate medical consultation is not automatically included in the test price; its provider, fee and terms must be disclosed before booking. GIM's contact channels do not provide emergency medical care.
9 Withdrawal and early performance
Details of consumer withdrawal rights are set out in the separate Withdrawal Notice and model form, available before ordering and supplied in a saveable form with the contract confirmation. Withdrawal may be declared by email to info@geneticinstitute.eu, by post to GIM's address in Section 1, or through the website's electronic withdrawal function. Using the model form is optional.
Early commencement of the service component before the withdrawal period ends may be requested by a separate express declaration. This is not an immediate blanket waiver of withdrawal rights. Proportionate payment for services performed before withdrawal may be claimed only with the required prior information, express request and statutory conditions. Merely starting analysis is not the same as completing the service.
For paid services, the withdrawal right may expire upon full performance subject to the statutory requirements for prior consent and acknowledgement. Different conditions apply to digital content; the electronic format of a report does not automatically remove rights for the entire package.
A statutory exception may apply to genuinely bespoke goods or goods clearly tailored to personal needs. For sealed goods unsuitable for return for health protection or hygiene reasons, the exception applies only under the statutory conditions after the seal is removed following delivery. We do not apply these exceptions indiscriminately to all tests, vitamins or creams; advance information is provided for the affected product.
The return address and responsibility for return costs following withdrawal are specified in the separate Withdrawal Notice. Withdrawing genetic data consent and withdrawing from the contract are different declarations.
10 Statutory conformity rights and complaints
Statutory rights concerning defective performance also apply to personalised products. For goods, statutory legal guarantee rights generally apply for at least two years from delivery under the applicable rules. This is not a two-year shelf-life or health outcome guarantee. The relevant statutory rules apply to digital content, digital services and analysis.
Complaints may be sent to info@geneticinstitute.eu or GIM's postal address. An order reference and description help us investigate; their absence alone does not remove a statutory claim. We examine the complaint, consult the laboratory or manufacturer where needed and explain the proposed resolution.
Applicable law determines the conditions for repair, replacement, repeat performance, price reduction, termination, refund or damages. Costs of remedying defects that GIM must bear by law are not passed on to the customer. Repair of goods also benefits from the one-off extension of the limitation period under applicable German rules.
11 Liability and governing law
GIM's liability is governed by law. These terms do not exclude or limit liability for death, personal injury or harm to health, intent, gross negligence, mandatory product liability or guarantees given. Involving a laboratory and the informational purpose of results do not constitute a general exclusion of liability.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers retain the protection of mandatory rules in their country of habitual residence. Mandatory rules govern jurisdiction; consumers are not required by these terms to use German courts exclusively.
Individual agreements take priority as provided by law. If a provision is invalid, statutory rules replace it; no economically similar provision imposing burdens on the customer is automatically substituted.
12 Data protection and separate declarations
The Privacy Notice and genetic data and sample processing information describe data use in ordering, communication and laboratory workflows. Accepting these terms does not replace any required explicit genetic data consent and is not consent to advertising or research.
Data protection consents and declarations requesting early performance serve different purposes. Marketing consent is not required to purchase. Accepting these terms does not restrict data subject rights.
13 Consumer dispute resolution
GIM is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body. This does not limit access to courts or other mandatory remedies. Separate information duties apply where direct resolution of a consumer complaint is unsuccessful.
